Chapter 282: Statement
Just one night has passed, and the news of Colombia's lawsuit against Xinghai Culture and the Black Hole Band has spread all over the Internet.
At first, it was just a small media report, but as more and more people noticed the matter, the news was quickly hit by the top of the hot search.
"Shame on you and throw it abroad!
When that keyboardist had a problem, I knew that the people in this band were not good birds, and I don't know why so many people liked them. ”
"Yes! I'm used to playing big names in China, and it's still that virtuous when you go abroad, and someone will treat you this time, right?"
"It doesn't matter if you play a big name or something, as a public figure, ignoring the terms of the contract and blatantly breaching the contract, this is a matter of quality!"
"How did this band become popular?"
"It is recommended to ban it! There is also that Xinghai culture, it is recommended that the tax department check it! There must be tax evasion!"
……
There was a mess below the comment area about this news, and comments like this were hotly commented on the top, and some simple netizens were quickly taken into the rhythm.
But more netizens cautiously reserved their opinions and waited for the follow-up development of the incident.
Their wait was wise, as Xinghai Culture was quick to respond.
?statement
First of all, thank you fans and netizens for your concern about the Black Hole Band.
As the agency of the Black Hole Band, Xinghai Culture would like to sincerely apologize for the troubles caused by the conflict between the company and Columbia Records in the United States in recent days.
As an excellent rock band in China, Black Hole Band has always been loved and supported by audiences at home and abroad with a positive music concept and a self-denial work attitude.
In order to further promote the excellent music of the Black Hole Band, our company signed a cooperation agreement with Columbia Records on September 13 to jointly develop the American record market and promote the English album "Rock or Bust" of the Black Hole Band (see the attachment for the scanned copy of the contract).
The agreement stipulates that Columbia Records will be responsible for the promotion activities of our company's artist Black Hole Band in the United States, with a frequency of no less than three times a week, and a publicity budget of 5 million US dollars, of which 20% will be borne by Xinghai Culture and paid to Columbia Records before September 20.
Our company should produce 100,000 copies of the physical album before October 15 and hand it over to Columbia Records, and Columbia should put this batch of physical albums on the shelves of its record stores and set up a special product train.
The proceeds from the sale of the album are collected by Columbia Records and settled in a unified manner.
During the promotion period, the artists of our company, the Black Hole Band, should cooperate with the promotional activities arranged by Columbia Records (see the attached contract scanned copy for specific terms).
On November 21, Columbia Records informed us by email that it had arranged for the Black Hole Band to record "The Ellen Show" on November 25.
At 9:45 p.m. on Nov. 22, the Black Hole Band Wang Lele, Batu, and Lu Qingsong left for New York and arrived at 11:05 a.m. PT on Nov. 23. Cao Wu was hospitalized with his mother's injuries and left for a visit at 1 p.m. on Nov. 23 and arrived in New York at 4:15 a.m. PT on Nov. 24.
However, after the Black Hole Band arrived in New York except for Cao Wu, they received the news that the recording had been canceled, and the reason for the cancellation was because the Colombian side accused us of not arriving in New York on time. They said that according to the usual practice, in order to prevent accidents during the recording, the Black Hole Band needed to arrive in New York two days in advance to wait for the recording, but the Black Hole Band did not arrive on time, so Columbia believed that our company constituted a breach of contract, and filed a lawsuit in the U.S. District Court for the Southern District of New York on December 10, suing our company for breach of contract and seeking liquidated damages.
As shown in the liability clause for breach of contract in the attachment (scanned copy of the contract), the contract does not expressly require the Black Hole Band to arrive at the event location two days before the promotional event.
After the Black Hole band arrived in New York, there were still 28 hours before the start of filming of "The Ellen Show", which was plenty of time.
Therefore, all the work of our company meets the requirements of the contract and there is no breach of contract.
In accordance with Paragraph 5 of Article 3 of Party A's Terms, Colombia canceled the promotional activities without reason, resulting in the Black Hole Band having fewer than three promotional activities in the same week, which is a serious breach of contract.
Our company has hired a team of professional lawyers and will go to New York for the first trial at the end of December.
Our company has always adhered to the development policy of win-win cooperation, does not cause trouble, and is absolutely not afraid of things.
Right and wrong, leave it to the law to judge, please don't be affected by the rhythm of people with intentions, stay rational, the Black Hole Band will not disappoint everyone, and Xinghai Culture will not disappoint everyone.

December 19, 2015
Xinghai Culture's statement quickly caused an uproar on the Internet.
Their response was swift, prompt, and most importantly, crisp enough.
Niu Li followed Cao Wu's suggestion and announced the contract straightforwardly, and only made some protective measures in key places.
And those who led public opinion were obviously stunned by this trick.
In the industry, let alone such a transnational cooperation company, even if it is a cooperation between two domestic companies, the contract is an important trade secret, and it is absolutely impossible to reveal it.
And Xinghai Culture was ruthless enough, and actually released all the scanned copies of the contract directly.
Cao Wu and Niu Li are very clear that the most taboo thing about this kind of thing is to drag mud and water and cover it up.
Most people have the ability to distinguish between right and wrong, and they only show one thing, that is, their hearts are empty.
This matter is not the responsibility of Xinghai Culture in the first place, and it is the most straightforward way to deal with it by exposing the problem as it is and leaving it to the public for judgment.
Public opinion on the Internet began to gradually reverse, and after understanding the specific situation, most netizens stood on Xinghai's side, and many netizens who were brought to the rhythm in the early stage also shouted to find out who was behind the trouble.
Just then, the Black Hole Band returned home.
At Modu Airport, from noon, many reporters began to squat in the rest area near the pick-up gate.
At half past eight in the afternoon, outside the fence outside the pick-up gate, a row of long guns and short guns had been erected.
The passengers who had just stepped off the plane and walked out of the pick-up gate were taken aback and didn't know what was going on.
Soon, there was a commotion in the media group.
"It's out! It's out!"
The flash starts flashing.
The group was pushing the luggage cart and walking out, and the first few were the four members of the Black Hole Band.
"Hello Black Hole, what do you think about the lawsuit against you about Columbia Records?"
