The plaintiff's reason for demanding that 38 Company repay the principal and interest of the loan is established, and this court supports it, while the plaintiff's reason for demanding that Wuda Company bear joint and several liability is not established, and this court does not support it. Wuda Company demanded compensation for economic losses from the plaintiff and 38 Company, but did not file a counterclaim, and this court did not hear the case. ……”

This judgment was handed down in March '97, and at that time, the People's Bank of China did not report the case to the Public Security Bureau as an economic fraud case introduced by the original mortgagor Wuda Company, nor did it file an appeal, but chose to apply for enforcement. Could it be that the experts of the Legal Department of the Citizen Bank ate porridge? Today, six years later, the fraud case has been reported, which is a bit intriguing.

Secondly, the focus of the case is that after the contract was signed, the loan was obtained without any notarization and mortgage registration, and the follow-up procedures were not handled by Xia Xia as stated in the report of the Hubei Branch, but by someone else, who did not go to the Land Bureau to participate in the matter at all.

Third, the bank lended money to the 38 joint-stock company, apparently with other plans: to require the 38 joint-stock company to organize a fixed deposit of 60 million yuan in order to get rid of the bank's own predicament. This shows that it is a relationship between banks and enterprises that use each other for their own purposes.

Fourth, it seems that the people in the summer did not leave the Citizens Bank quietly, as expected. As an outstanding party member of the Citizens Bank, he specially left his handwriting, and asked the president and vice president of the Citizens Bank to sign it. This shows that summer is not an idle person.
