The executive branch of the Government shall, on the first day of the first month of the aforesaid month, declare by proclamation that the people of those states or parts of those states are at that time rebelling against the United States, if any, and that on that date the fact that any state or its people are elected by a majority of the legitimate electors to the Congress of the United States, and there is no strong evidence to the contrary, shall be that there is no conclusive evidence of resistance to the United States by that state or its people'.
Wherefore now, I, Abraham Lincoln, President of the United States, have been entrusted with the authority of Commander-in-Chief of the Army and Navy of the United States in times of armed rebellion against the authorities of the Government of the United States, and as an appropriate and necessary strategic measure for the suppression of the said rebellion, hereby on January 1, 1863, for a period of one hundred days from the date of the first time foregoing, I declare publicly for this purpose that those now opposing the United States are:
Arkansas, Texas, Louisiana (except the counties of St. Bernard, Praquamin, Jephesun, St. John, St. Charles, St. James, Assenxiang, Yasenpuhin, Deribaune, Lavalsh, St. Mary, St. Martin, and Orleans, including the city of New Orleans), Mississippi, Alabama, Florida, Georgia, South Carolina, North Carolina, and Virginia (excluding the forty-eight counties of West Virginia, and Berkeley, Akonmac, Northumbton, Elizabeth, York, Princess Ann, Norfolk and other counties, including Norfolk and Portsmouth), are now in their status before this proclamation is maintained.
For the foregoing end, I have used my authority to formally command and proclaim the eternal liberty of all those who are slaves in the aforementioned states, and in the aforementioned areas of certain states, now and in the future, and that the Government of the United States, including the authorities of the Navy and Army, shall recognize and maintain the liberty of the aforesaid persons.
I now command those who have been declared free not to commit any offence except in necessity of self-defence, and I advise them that, whenever possible, they should work faithfully for a reasonable wage.
I further declare, under appropriate conditions, that these persons may take part in the military service of the United States, by stationing batteries, positions, garrisons, and other areas, and serving on warships of all kinds.
I sincerely believe that this act is a just act, in accordance with the provisions of the Constitution, and in accordance with military necessity. I pray for the prudent judgment of mankind and the grace of God Almighty.
