After listening to Jiang Wenwen's words, the third uncle Jiang Zhushang said:
"Jiang Wenwen, listen to your tone, you are very familiar with this document, then please explain the content of this document to us in detail. ”
Jiang Wenwen said with a smile:
"Second uncle, third uncle, then I'll talk about the background of this document first!"
So Jiang Wenwen said that there are four background reasons for the relevant ministries and commissions of the state to issue this document.
First, it is necessary to implement the requirements of the CPC Central Committee and the State Council for vigorously developing tourism. Now the state attaches great importance to the development of tourism, the Fifth Plenary Session of the 18th Central Committee of the Communist Party of China will "vigorously develop tourism" as an important part of the "13th Five-Year Plan" period to build a new industrial system.
Especially in the past year or two, the state issued a number of opinions on promoting the reform and development of tourism, clearly put forward that "tourism is an important part of the modern service industry, leading the way, is to adapt to the people's consumption upgrading and industrial restructuring of the inevitable requirements", and to reform and improve the tourism land management system has been deployed.
After that, the state issued the "Several Opinions on Further Promoting Tourism Investment and Consumption", which further clarified the specific goals of tourism development. It can be said that the relevant ministries and commissions of the state issued the document on tourism land in order to implement the relevant requirements at the national level.
Second, the objective need to promote the reform and development of the tourism industry.
With the rapid development of tourism in our country, there are many new situations and new problems in its land use, which need to be solved urgently.
First, the planning is insufficient, and some tourism construction projects are difficult to land. The construction of tourism public service facilities in some scenic spots is insufficient, and the demand for land for new facilities has begun to emerge.
Second, the land use policy is not systematic enough.
Tourism is a comprehensive industry with a complex variety of land uses and types of rights.
In terms of land use, it includes three types of construction land, agricultural land and unused land, and in the construction land, it includes accommodation, catering, recreation, sports and entertainment, medical and health care, transportation, parks and green spaces.
In terms of the types of rights, there are both state-owned construction land and collective construction land.
For a long time, the land use policy of tourism has been scattered in other industries, which is not only unsystematic, but also has the problem of unclear policies in some areas.
Third, the land use policy for new forms of tourism needs to be clarified urgently.
With the rise of new products and new formats such as rural tourism, cultural tourism, self-driving RV tourism, cruise yacht tourism, and research tourism, there is a strong demand for new land use policies.
Therefore, reforming and improving the management system of tourism land, promoting the combination of differentiated land management and guiding the adjustment of tourism supply structure have become a new topic for land and resources departments to support the development of tourism.
Third, the land and resources departments have taken positive actions to understand the new normal and perform their duties and new positioning.
Focusing on the goal of maintaining medium-to-high-speed economic development and structural adjustment towards the mid-to-high-end level, and in accordance with the new positioning requirements of "conscientiously protecting land resources, saving and intensive utilization of land resources, and doing our best to safeguard the rights and interests of the masses", the land and resources department attaches great importance to the construction of the industrial land policy system.
Based on the important position of tourism development in "playing the basic role of consumption in growth and playing the key role of investment in growth", focusing on the particularity of land for tourism development, and studying and promulgating policies to support tourism development in accordance with the principles of administration, reform and innovation, market allocation, and economy and intensification, it is a positive action for the land and resources department to understand the new normal, adapt to the new normal, and lead the new normal. Another major measure to benefit the people's livelihood is to accelerate the establishment and improvement of the industrial land policy system and a new cornerstone.
After Jiang Wenwen introduced the background of the document, she said:
"The second uncle, the third uncle, from the national to the local land and resources departments, are very important to the tourism land, our Chenxi Dazhai - 100 bamboo forest project is so smooth, but also thanks to the county and town land and resources departments of the active action, from the planning report to the final signboard, many times the land department took the initiative to find us, urging us. ”
"Second uncle, third uncle, the current land department is very different from the past. Tian Limai also said.
"In fact, what I'm most worried about is the land issue, no matter what kind of development is carried out, if the land is not realized, it is just an empty word, and the signed contract is just a piece of straw paper. Second uncle Jiang Zhumin said.
Third uncle Jiang Zhumin says:
"Jiang Wenwen, Tian Limai, how about you introduce the relevant content of this document on tourism land?"
Tian Limai glanced at Jiang Wenwen and said with a smile:
"Second uncle, third uncle, this document, I took it with me every day for a while, and I took it out to study it when I had time, and now I am quite familiar with the content of the document. ”
"Tian Limai, then you can roughly introduce the content. Second uncle Jiang Zhumin said.
"Okay. Tian Limai agreed.
Tian Limai said that the document issued by the relevant state departments actively guarantees the land for tourism development from six aspects.
(A) the effective implementation of key tourism projects to add new construction land.
In order to ensure the smooth implementation of key construction projects, the document proposes three safeguard measures in response to the problem of insufficient planning cohesion.
The first is to establish an effective planning cohesion mechanism.
In accordance with the "Land Management Law", "Tourism Law" and other relevant laws and regulations, it is emphasized that all localities should speed up tourism development planning in accordance with the principles of resource and ecological protection, cultural relics safety, and conservation and intensive land use, and do a good job in connecting with the overall land use planning, urban and rural planning, scenic spot planning, environmental protection planning and other related planning, so as to lay the foundation for the development of tourism in accordance with the law and according to the plan.
The second is to ensure the use of land in a timely manner in accordance with the construction sequence of tourism projects.
For tourism projects that are in line with relevant planning, they will be guaranteed to be implemented in a timely manner according to the construction schedule.
The third is to increase the guarantee of land for poverty alleviation through tourism.
Poverty alleviation of the rural poor is the most arduous task of building a moderately prosperous society in an all-round way, and the tourism industry has a large employment capacity and strong economic driving force, and plays an increasingly significant role in China's poverty alleviation and development. It is becoming a new force in China's poverty alleviation.
Therefore, the document specifically puts forward the policy requirements of increasing the guarantee of land for tourism poverty alleviation.
At the same time, the document also clarifies the land use policy for rural tourism, and supports tourism poverty alleviation from two aspects: clear land supply and mode.
(2) Support the use of unused land, abandoned land, remote islands and other land for the construction of tourism projects.
In accordance with the provisions of the State Council document, combined with the overall requirements of ecological civilization construction, the document further refines the policy on the use of unused land, abandoned land, remote islands and other land for tourism projects.
First, for tourism projects that use land in barren mountains, wastelands, barren beaches, rocky desertification, and remote islands, priority will be given to the new construction land plan indicators.
Second, for the use of the above-mentioned land for the construction of tourism projects, the reserve price of the transfer can be determined according to the principle of not less than the sum of the cost of land acquisition, the cost of pre-development of land and the relevant fees that should be charged according to the regulations.
The third is to combine the development of tourism projects with land reclamation to promote the integration of economic, social and ecological civilization.
To this end, the document proposes two policy measures.
On the one hand, support all localities to formulate support policies in accordance with the relevant provisions of the "Land Reclamation Regulations", and encourage land rights holders to reclaim and develop tourism projects such as garbage dumps and abandoned mines on damaged land left over from history.
On the other hand, for the damaged land left over from history recovered or expropriated by the government, it is allowed to merge and determine the new land use right holder and the reclamation investor through bidding, auction and listing, so as to attract private capital investment.
(C) the implementation of the tourism land classification management system in accordance with the law.
In view of the fact that there are many types of land for tourism, the ecological landscape involves agricultural land and unused land, and the characteristics of the nature of the land are generally not changed, the document proposes to implement a classified management system for tourism land.
The land involved in the construction of permanent facilities in tourism projects shall be managed according to the construction land in accordance with the law;
For land that belongs to natural landscapes and land for farming, animal husbandry and fishery planting and aquaculture, the nature of the land right is not changed, that is, it is still used and managed by the existing land rights holder, and the use of land is not changed, that is, the land that belongs to agricultural land is still managed as agricultural land, and the land that belongs to unused land is still managed as unused land.
The economic relationship between this part of land use and tourism operation shall be resolved through negotiation between the relevant parties in accordance with the law.
The implementation of classified management in accordance with the law is not only conducive to reducing the scale and cost burden of land conversion and expropriation for construction projects, but also ensuring that the local people do not lose their land due to the development of tourism projects, but can participate in the operation and share the benefits of the project.
(4) Supply of construction land in multiple ways.
In view of the problem that the land used for the construction of tourism involves a variety of planned uses and the use of some land is not clear, in order to support the development of tourism and standardize the supply and management of tourism land, the document mainly puts forward three policies.
In the case of tourism-related construction projects:
The first is to strictly implement the relevant laws and regulations on land bidding, auction and listing, and require that if the use is mixed and includes commercial use, it shall be supplied by bidding, auction and listing.
The second is to clarify the planning use of part of the tourism land, at the same time, in order to reflect the support for the development of the tourism industry, the planning and supply management has been coordinated, part of the tourism project land planning use is classified according to the national standards, the supply mode, price, service life is implemented according to the provisions of the statutory "tourism land".
The third is to encourage the supply of land for tourism projects in the form of long-term leases, leases before concessions, and concessions, so as to reduce the initial land costs for tourism project development.
(E) to increase the protection of tourist toilet land.
The state attaches great importance to the role of tourist toilets in the development of tourism as a window of civilization and basic public services.
In the national document, it is clearly stated that it will take three years to build and renovate 57,000 toilets in the country, in view of the small and scattered characteristics of tourist toilet land, in order to support its construction, the document proposes three policy measures.
First, if the new construction land needs to be used for the new construction and reconstruction of tourist toilets and related fecal harmless treatment facilities, it can be applied for in a centralized manner at multiple points of the same kind, and the new construction land plan index support will be given.
Second, the fecal treatment facilities that meet the "Catalogue of Allocated Land" can be supplied by allocation.
The third is to encourage the construction of tourist toilets in other projects to increase the supply of tourist toilets and promote the conservation and intensive use of land and other resources.
(F) to clarify the new tourism land use policy.
In view of the characteristics of land use for new forms of tourism, in accordance with the principle of encouraging the use of stock and standardizing the use of increments, the land use policies for rural tourism, self-driving, cruise yachts, culture and research have been clarified in accordance with the law.
The first is to guide the standardized development of rural tourism.
Rural tourism is a key area for the development of tourism at present and in the future, and it is also the key to poverty alleviation through tourism.
In accordance with the "Land Management Law", "Tourism Law" and other relevant laws and regulations, as well as the characteristics of rural tourism, the document proposes four land use regulation measures:
First, the development of rural tourism can use collective construction land, but should be in line with the relevant planning premise, rural collective economic organizations for their own use and in shares, joint ventures and other legal ways.
Article 2: Urban and rural residents may use their own residences or other conditions to engage in tourism operations in accordance with the law, but according to the provisions of the Tourism Law, the application of this policy is premised on the formulation of management measures by the provinces, autonomous regions and municipalities directly under the Central Government.
Article 3 Units and individuals other than rural collective economic organizations may use agricultural land or unused land owned by peasant collectives to engage in planting, forestry, animal husbandry, and fishery production related to tourism, but this should be done through contracted operation and circulation in accordance with the law.
Fourth, optimize the layout of rural construction land and build tourism facilities, which can be carried out by carrying out pilot projects linking the increase and decrease of urban and rural construction land.
The second is to promote the orderly development of self-driving and RV camp tourism.
Self-driving RV camps are a new form of tourism industry and a new hot spot for tourism consumption, and the document proposes three policy measures in view of the distribution characteristics of self-driving RV camps mainly concentrated on the edge of cities and tourist attractions.
Article 1: In accordance with the relevant regulations of the State Council, it is reiterated that the emphasis is placed on speeding up the formulation of self-driving RV camp construction planning and construction standards.
Article 2: In order to effectively prevent environmental pollution in the operation of self-driving RV camps and implement the concept of green development, the relevant requirements of land supply and planning management and construction requirements have been strengthened and refined by giving full play to the synergy of departments, so as to ensure that the construction and operation of self-driving RV camps are coordinated with the natural and cultural environment of the area.
Article 3, from the two aspects of standardized management and support for development, clarifies the use management, supply mode and service life of the land for the self-driving RV camp project.
The third is to support the optimal development of cruise and yacht tourism.
Cruise, yacht tourism is a new consumer field, is in the cultivation stage, in order to support its development, in accordance with the direction of land use system reform, the document put forward two policy measures.
Article 1: Land for new cruise ships and yacht marinas shall be used for a fee and may be supplied by agreement.
