2. Where this crime is committed, and the circumstances are serious, the sentence is to be between 3 and 10 years imprisonment and a fine. The so-called serious circumstances refer to the huge amount of money or other serious circumstances. According to the Interpretation, the so-called huge amount refers to the theft of public or private property by individuals with a value of 5,000 yuan to more than 20,000 yuan. The starting point for the theft of special VAT invoices or other invoices that can be used to defraud export tax rebates and tax deductions is 250. "Other serious circumstances" refers to other serious circumstances other than the huge amount. According to Article 6, Paragraph 3 of the Interpretation, where the amount stolen reaches the threshold of "relatively large amounts" and has any of the following circumstances, it may be found to be "other serious circumstances":
(1) The ringleader of a criminal group or the principal offender in a joint crime where the circumstances are serious;
(2) theft of financial institutions;
(3) Wandering and committing crimes that cause serious harm;
(4) recidivism;
(5) Causing the victim's death, mental disorder, or other serious consequences;
(6) Stealing funds and materials for disaster relief, emergency rescue, flood control, preferential care, poverty alleviation, immigration, relief, or medical treatment, causing serious consequences;
(7) Theft of means of production, seriously affecting production;
(8) Causing other major losses.
In addition, according to the provisions of Article 9, Paragraph 1 of the Interpretation, anyone who steals national second-class cultural relics shall also be sentenced to fixed-term imprisonment of not less than 3 years but not more than 10 years and a fine according to this range.
3. Where this crime is committed, and the circumstances are especially serious, a sentence of 10 or more years imprisonment or indefinite imprisonment is to be given, and a concurrent fine or confiscation of property, where the circumstances are especially serious, refers to especially huge amounts or other especially serious circumstances. The so-called "particularly huge amount" refers to the theft of public or private property by individuals with a value of 30,000 yuan to more than 100,000 yuan, according to the Interpretation. According to Article 6, Paragraph 3 of the Interpretation, where the amount stolen reaches the threshold of "huge amount" and has any of the following circumstances, it may be found to be "other particularly serious circumstances":

Unit theft
Where a unit cannot constitute the subject of the crime of theft, but a unit collectively steals public or private property, and the stolen property is owned by the unit, the person directly responsible shall be investigated for criminal responsibility for the crime of theft.
