Chapter 16 Zhu Qizhen's Heart of the Ming Dynasty
Chapter 16 Zhu Qizhen's Heart of the Ming Dynasty
Wang Shu took a deep breath and looked at the Qianqing Palace.
Zhu Qizhen had summoned ministers in Wenhua Hall and Wuying Hall respectively before, but as Zhu Qizhen's authority became more and more deeply rooted in the hearts of the people, Zhu Qizhen's sense of ritual became weaker in some things.
After all, a lot of times, the sense of ritual reinforces the lack of authority.
Zhu Qizhen is no longer needed.
Although the Qianqing Palace is a dormitory, it actually has a large area and can divide many areas. There is no delay in office and rest.
Zhu Qizhen had to summon ministers every day, and Wang Shu was also summoned by Zhu Qizhen many times.
Every time you are promoted, you have to thank you. But a lot of the time it's ceremonial.
Some time ago, Zhu Qizhen summoned a large number of ministers, and Wang Shu also expressed his thoughts in front of Zhu Qizhen. What he said was some of the content of strict rule.
Maybe Zhu Qizhen himself forgot about it, but Wang Shu still remembered it.
It was the first time he had played a solo match.
And this time it's the second time.
Wang Shu, under the guidance of the eunuch, entered the Qianqing Palace.
The first thing Zhu Qizhen saw was a Shaanxi man, and he always felt that with his figure, he should not be wearing an official robe, but wearing heavy armor, holding an eight-foot sword, and being a Mo sword general.
After the king bowed.
Zhu Qizhen ordered him to sit down and asked, "The Ming Huidian is a grand event of this dynasty, how to repair, do you have any ideas?" ”
Wang Shu said: "The minister is ready to use the "Emperor Ming Ancestral Training", "Da Ming Law", "Zhu Zhi Zhang" and so on as the blueprint, and according to the various changes in the imperial court since Taizong, in chronological order, divided into categories. ”
Zhu Qizhen shook his head and said, "This is not the Ming Huidian I wanted. ”
Wang Shu said, "What does Your Majesty mean?" ”
Zhu Qizhen said: "Emperor Taizu established the ancestral training and promulgated the "Great Ming Law", thinking that it is not easy to be reasonable, but now it is mostly not used, is this Emperor Taizu's mistake? ”
Wang Shu listened to Zhu Qizhen's words, but he didn't dare to answer.
Zhu Qizhen can talk about this topic without any scruples, but if Wang Shu dares to talk nonsense, he just doesn't know that the sky is high.
Zhu Qizhen didn't want Wang Shu to say anything, but now continued: "It's really the law of the Ming Dynasty that can't rule the world. This sentence is really Zhu Qizhen's sigh for many years of governing the country.
Later generations publicized the legal system, saying that there is a law to follow, and if there is a law, it must be followed. Many people probably think it's nonsense, if the law is not enforced, what do you want the law to do.
But Zhu Qizhen clearly felt this in the political ecology of the Ming Dynasty.
The legal system of the Ming Dynasty is unable to deal with the governance of the Ming Dynasty.
This point has also been expressed in the edicts of successive emperors.
If the state makes a decision now, it is based on what laws and regulations
out of such a decision. But in the Ming Dynasty, there were a large number of edicts, that is, what kind of decision the emperor made about a certain matter, and then at the end of the "book for the order." Or" as an example. "The order and the precedent are consent.
This results in a dazzling array of examples and stories.
In the future, when the imperial court makes decisions, it will rely on the case of such and such as the beginning.
This is also the reason why the emperor exported to the constitution. Every word of the emperor can become the law itself.
For the emperor and the hundred officials, there is a great degree of discretion. This resulted in a lot of strange behaviors, which later generations could not understand, but at the time it was a fact.
For example, the head of some banknotes, after collecting enough quotas, actually opened the banknotes customs to exempt the taxes of the people in the past.
This is clearly the benefit of generosity to the country, and to invite one's own name. But if at the legal level, there is simply nothing to cure him. This kind of drawbacks reminded Zhu Qizhen of the political class he took at the beginning.
Yes, the legal system of later generations seems to be ordinary, but in fact, it is many times more clever than the legal system of the Ming Dynasty. This is also the private goods that Zhu Qizhen wants to give to the "Daming Huidian".
It is a whole set of laws with the same logic, from the constitution to various special laws, as well as the laws and regulations that can be issued by various yamen, this kind of layered legal system.
I won't talk about it here.
If you don't understand, ask your political teacher.
According to Wang Shu, the "Ming Huidian" compiled by him is actually a compilation of information on the changes in the Ming Dynasty rules and regulations, although there is a certain practical guidance.
But what Zhu Qizhen wanted to compile was a modern Ming code.
In fact, if you really want to say it, this matter may not be beneficial to the emperor.
Because before, the power of the Ming Emperor was unlimited, and the laws of the Ming Dynasty were not even as good as some unspoken political rules. The emperor had ample room for power.
But if such a legal system is established and a complete legal system is formed, he restricts not only the power of hundreds of officials, but also the power of the emperor.
Zhu Qizhen has also thought about this.
If according to the evolution of history, the Ming and Qing dynasties finally evolved into the supremacy of the monarchy, this evolution began with the abolition of the prime minister by Emperor Taizu. Finally, under the indoctrination of the slave mentality of the Qing Dynasty, the final construction was completed.
In the end, there was only one person in the whole of China, that is, the emperor, and the rest of the people were all slaves, or people who could not be obtained by asking to be slaves.
It also led China into a dead end.
And in the Han regime, but in that dynasty, the emperor's power was never unlimited. This is true even today. It's nothing more than asking the scholar to change something to limit the monarch's power.
For the emperor who has made a difference, there is no difference in the face.
For the emperor who has not done anything, An An is divided into a mediocre master, and
What not?
Of course, Zhu Qizhen still has some dark thoughts in his heart. That is, even if the "Daming Huidian" is successful. The Ming monarch who could only restrict him could bring the tightening spell on his head.
He doesn't want to care about the affairs of his children and grandchildren in the future, and he can't take care of it.
Zhu Qizhen carefully combined his thoughts with the reality of the Ming Dynasty and told Wang Shu to listen.
The more Wang Shu listened, the more serious he became, the more solemn he became, and in a trance, he had the feeling of listening to a lecture in front of the teacher. He also served as a magistrate, so he naturally knew what the situation was like in various places.
Zhu Qizhen told him about this system, which made Wang Shu feel excited, but he was very frightened.
The excitement lies in the fact that if this thing can really be completed, then the political risks of the Ming officialdom will take on a new look, and many things can be avoided. The administrative capacity of the state can also be greatly improved.
But Wang Shu became more and more frightened in his heart, that is, this seemed to be the legendary Qin Law. Strict, secret, and all-encompassing.
What Wang Shu is worried about is that such a dense legal net seems to greatly increase the national strength and sort out the top and bottom, but it will cause the consequences of the death of the second emperor.
Wang Shu couldn't help but say: "Your Majesty, this matter is the Qin Law, and it must not be left behind from the Law family." ”
Zhu Qizhen listened, smiled lightly and said: "Since the Han Dynasty, Confucianism has been separated, saying that this is the Qin law, and it is even more excessive, the Qin law is brutal, I just attribute the laws of the Ming Dynasty here, Wang Qing is again, is the law of this dynasty cruel?" ”
To be honest, if it is only Taizu Taizong's means, it is indeed a little, but Wang Shu does not dare to say so.
Wang Shu Zhengse said: "Your Majesty, the disadvantages of the Qin Law are not on the brutal side, everything is broken by the law, so that people do not obey the law, the denser the law, the deeper the disadvantages, this is also the other." ”
"The world is big, each is different, Taizu set the world, but also because of its vulgarity, and now it is broken by the law, I am afraid that the people are ignorant and repeatedly violate the ban, how to deal with it? If the law of the court is not severely punished, the people will be chaotic. ”
"Therefore, the meaning of the emperor of Kaolidai is that it is all the moral master and the criminal auxiliary."
Zhu Qizhen is not worried about what Wang Shu said about obeying the law and not obeying the king, after all, the scholar still holds high the slogan of obeying the way and not obeying the king, as if you don't know what to do, you will obey the emperor.
It's a joke.
But the two points that Wang Shu said made Zhu Qizhen have to ponder.
One is that the tighter the legal net, the more metaphysical it becomes. The more likely the result of the law is to deviate from universal morality.
It's like there are some cases where jurists have a complete set of arguments, but this result is not considered right by everyone, but it cannot be refuted.
Thus extending the terms of procedural justice, substantive justice, and so on. It was created to solve this problem.
This is what Wang Shu said, the more secret the law, the deeper the evils. What Wang Shu said is not unreasonable.
