Observance of the Constitution and preservation of the national system is the proper meaning of the topic, and political parties must operate within the framework of the Constitution. The promulgation of the "Law on the Organization of Political Parties" has made it necessary for the "big names" in the existing political arena to seriously consider it, because after the "Law on the Organization of Political Parties", there is also a revision of the "Law on the Organization of the National Assembly", which carries a heavier weight and will directly determine the composition of the Government Council.
The Organic Law on Political Parties merely regulates the formation and operation of political parties, and the Organic Law of the National Assembly will determine the power structure of the Republic.
The Organic Law of the National Assembly is divided into two houses, the Senate and the House of Representatives, with the Senate tentatively set at 90 seats. The reason why it is 90 seats is determined by three seats per province (including municipalities directly under the central government at the same level as the provincial government). Members of the House of Representatives are elected by population. It embodies the basic meaning of democracy. The Constitution makes it clear that the President, as the head of State, has the supreme executive power. He is the Supreme Commander of the Armed Forces of the Republic. On the executive side, the president nominates the prime minister to the National Assembly, and after separate deliberations by the Senate and the House of Representatives, a vote is held, and more than half of the votes take effect. The Prime Minister is accountable to the President and is mandated to form the Council of Ministers, which serves as the highest administrative organ of the country. The appointment and dismissal of ministers and governors of provinces shall take effect after being nominated by the Prime Minister and submitted to the President for approval. Among them, the Ministry of National Defense, the Ministry of Police and the Ministry of Justice are under the direct control of the President and are not under the leadership of the Government Council.
In terms of the armed forces, the active and reserve forces of the Defence Force are under the leadership of the President. The organization, transfer, and appointment of generals of the armed forces are the responsibility of the President or an agency authorized by the President.
In the case of Congress, power is not limited to legislation. On the face of it, Congress wields the most power.
The first is to decide on the presidency and vice presidents. In accordance with the provisions of the amendment to the Constitution and the Organic Law of the National Assembly, the election of the president in the future will be nominated by the majority party in the House of Representatives, and the number of seats will be two, that is, the first and second major parties in the House of Representatives will each propose their own presidential candidates, and after being approved by more than half of the members of the House of Representatives, they will be submitted to the Senate for a closed-door election to elect the president and vice president. The Vice President shall exercise the powers of the President in the event that the President is unable to act as a matter of time.
The second is the state's right to decide on important matters. The country's declaration of war on foreign countries, the establishment and severance of diplomatic relations, and the government's budget all require the approval of Congress.
The third is the right to know about national priorities. The President reports to Congress at least once a year and is subject to deliberation by Congress.
Not only that, but Congress also has the power of impeachment against the president, and can initiate impeachment proceedings if it believes that the president is unconstitutional or illegal, or that he is derelict in his duties. When more than two-thirds of the votes are cast, impeachment takes effect, and the president must step down and face a judicial investigation.
The Organic Law of the National Assembly also stipulates in detail the work and powers of the Senate and the House of Representatives. The powers of the Senate and the House of Representatives are not equal. The House of Representatives acts as a primary deliberative body, and matters are subject to the approval of the Senate. The Senate has the power to veto bills in the House of Representatives, but the House of Representatives does not have the power to veto decisions in the Senate.
Members of Congress, whether senators or representatives, enjoy judicial immunity. The powerful institutions of the Republic may not restrict the personal liberty of deputies without having been discharged from their status by statutory bodies.
The Speaker of the Senate and the Speaker of the House of Representatives are paid by the President, and the Vice-Chairmen of the House of Representatives are paid by the Prime Minister. Parliamentarians are paid more than ministers and governors.
The form of government established by the new China is different from any of the existing so-called democratic countries. The Organic Law of the National Assembly, after clarifying the rights and obligations of the Senate and the House of Representatives, also clarifies that no official at or above the department level in a government agency may serve as a member of the National Assembly. This is an extremely important one. The move "splits" the parliament and the government, with lawmakers not holding senior government positions. Moreover, they are not allowed to do business, sit and talk about the Tao, and concentrate on the discussion of national affairs. Senior government officials are not allowed to participate in the deliberations and decisions of the National Assembly on the country's priorities and concentrate on government affairs. If you want to exert influence on the country's major policies, then you can do it through your political party.
As a result, senior government officials in Congress, such as Soong, president of the Supreme Court, will have to make a choice.
Under this system, the role of political parties becomes prominent. Without an influential political party, it is difficult for politicians to get into the House of Representatives.
