The laws governing tomb robbing are as follows:

Article 2 of the Law of the People's Republic of China on the Protection of Cultural Relics (revised on October 28, 2002) Within the territory of the People's Republic of China, the following cultural relics are under the protection of the State: (1) ancient cultural sites, ancient tombs, ancient buildings, cave temples, stone carvings and murals with historical, artistic and scientific value: (2) important historical sites, objects and representative buildings of modern and modern times related to major historical events, revolutionary movements or famous figures, and with important commemorative significance, educational significance or historical value; (3) Precious works of art and arts and crafts in all eras of history.

Whoever commits this crime is to be sentenced to up to five years imprisonment or short-term detention and a concurrent fine; where the circumstances are especially serious, the sentence is between 5 and 10 years imprisonment and a concurrent fine. Where a unit commits this crime, the unit shall be fined, and the directly responsible managers and other directly responsible personnel shall be punished in accordance with the above provisions.
