But when he returned to Missouri in 1838, he was re-enslaved.
In 1846, Scott filed a petition in Missouri to restore his freedom on the basis of a resident of the free land who had twice been free, and the first instance was won, but the Missouri court rejected it.
Scott appealed to the U.S. Supreme Court.
Under the control of the Southern slave owners, on March 6, 1857, the Federal Supreme Court ruled:
"Scott was a black slave.
Slaves are the property of slave owners and are not U.S. citizens, and have no right to appeal to federal courts, which cannot be extinguished except through due legal process, which Scott has not previously done.
Because citizens' property is constitutionally protected, neither Congress nor local legislators have the power to declare a ban on slavery anywhere in the United States. ”
As early as 1820, Congress passed the Missouri Compromise, which provided for the division of slave states and free states at 36 degrees 30 degrees north latitude, with slavery allowed in the territories south of the line and forbidden in the territories north of the line.
And this judgment effectively declared the Missouri Compromise unconstitutional and that slavery was legal in all U.S. territories.
