The original, the 1978 version of the Government Ethics Act, provided that the Minister of Justice would first conduct a preliminary investigation for a period of 90 days when receiving information about violations of federal criminal law by senior government officials.

At the end of the preliminary investigation, if the Minister of Justice cannot conclude that there is no factual basis to warrant further investigation, the case shall be transferred to the Federal Court of Appeal of the District of Colombia, where a panel of three judges shall appoint a special prosecutor
