"Victim's fault" in the sense of criminal law refers to the victim's subjective fault in carrying out wrong or improper conduct, and the conduct violates the law, social public order, good customs, ethical norms, etc., infringes upon the defendant's lawful rights and interests or other legitimate interests, and objectively stimulates the occurrence of criminal conduct.
In judicial practice, the determination of whether a victim is at fault in the sense of criminal law is generally considered from the following aspects:
1. The subject of the wrongdoing must be the victim.
2. Subjectively, the victim should be at fault. That is, the victim's subjective intentional or negligent state of mind should be legally or morally condemned. If it is another act that is not attributable to the victim, it cannot be found to be the fault of the victim.
3. The victim's conduct violates legal provisions, or violates social order, good customs, or ethical norms, and shall be negatively evaluated by society.
4. There is a causal relationship between the victim's wrongful conduct and the occurrence of the defendant's criminal conduct, and there is a correlation between it.
Returning to this case, based on the evidence on record, we can know the following:
First, Wu Jianguo's statement and the testimony of witnesses all confirm that the quarrel between the defendant Li Zhiguo and Wu Jianguo was provoked by Li Zhiguo.
Second, Wu Jianguo and the witnesses both confirmed that at the time of the crime, it was Li Zhiguo who first slashed people with a knife, and then Wu Jianguo picked up a stone to hit Li Zhiguo, and it was the defendant Li Zhiguo who made the first move.
Although Wu Jianguo caused Li Zhiguo minor injuries in the process of picking up a stone and hitting Li Zhiguo, this was caused by Li Zhiguo's prior aggression. There is no causal relationship between Wu Jianguo's conduct and Li Zhiguo's criminal conduct, so Wu Jianguo's conduct is not a wrongful act in the sense of the criminal law.
Therefore, I believe that Wu Jianguo's actions were in the nature of legitimate self-defense and were not at fault in this case. Li Zhiguo should compensate the victim Wu Jianguo in full.
