Gong Da lives in an old building, in Room 201, the house is very small, and the windows are sealed in winter, so there is no smell of natural gas outside.

At nearly 11:40 a.m., the eldest sister in her 40s in room 301 upstairs started cooking with a fire, and soon after she lit the gas stove, there was a bang and an explosion occurred. The eldest sister was injured on the spot, and her face turned blindfolded, and she didn't know what was going on.

Gong Da, who was tearing down his eyes and reminiscing about the past, was startled when he heard the explosion upstairs, and suddenly remembered that the match he had prepared had been placed in the kitchen, so he rushed into the kitchen with the pungent gas and planned to find the match and commit suicide.

Because the kitchen was relatively small and the light was not good, he subconsciously touched the light switch in the kitchen, which caused a big explosion at this moment. This explosion was much larger than the explosion in room 301 upstairs, the floor of the bedroom was directly blown through, and the security door of room 201 was blown open, and the security door of room 202 on the opposite side was blown out of shape.

Deng Chunji, who is in his thirties and lives in room 202 opposite Gongda, happened to come back from a trip and had just walked to the door of his house to open the door with the key, but was killed on the spot, two other neighbors were slightly injured, and the windows and walls of many residents' homes were damaged to varying degrees.

The falling objects of the explosion caused damage to many vehicles parked nearby, with a total loss of more than 100,000 yuan.

After the explosion, someone called the emergency number and called the police. Subsequently, the doctor sent Gong Da and others to the hospital for treatment. A few months later, the procuratorate indicted the defendant Gong Da with the Intermediate People's Court for the crime of endangering public safety by dangerous means.

Although Gong Da's parents felt that their son was a nest, after all, he was his own son, and now that he was facing a sentence, they found Song Hui through an acquaintance's introduction and entrusted him to handle the case.

After the trial, the Intermediate People's Court held that the defendant Gong Da released natural gas at home in order to commit suicide, causing the natural gas to explode, causing heavy losses to the life, health and property of the surrounding neighbors, seriously endangering public safety, and his conduct constituted the crime of endangering public safety by dangerous means.

Accordingly, in accordance with the provisions of Article 115 and Article 57, Paragraph 1 of the Criminal Law, the defendant Gong Da was sentenced to death and deprived of political rights for life for the crime of endangering public safety by dangerous means.

After the first-instance verdict was announced, the defendant Gong Da appealed on the grounds that the sentence in the original trial was too heavy. Song Hui continued to defend him, arguing that Gong Da committed an indirect intentional crime, behaved well in normal times, truthfully confessed the crime, and was willing to actively compensate, and recommended that Gong Da be given a lenient punishment.

After the second trial, the Provincial High Court held that the defendant Gong Da disregarded public safety in order to commit suicide and released natural gas to cause continuous explosions, causing deaths and injuries to innocent people and major property losses, and his conduct constituted the crime of endangering public safety by dangerous means.

Based on the on-site investigation and the extraction of physical evidence, and with reference to the appraisal opinion on the cause of the explosion issued by the appraisal agency during the second-instance trial, it can be determined that it was a natural gas explosion, and the evidence in the case can form a complete chain of evidence, which is sufficient to determine that there is a causal relationship between Gongda's act of cutting the hose to release natural gas and the eventual explosion.

Accordingly, in accordance with the provisions of Article 225, Paragraph 1, Item 1 and Article 235 of the Criminal Procedure Law of the People's Republic of China, the appeal was rejected and the original judgment was upheld, and it was reported to the Supreme People's Court for approval in accordance with law.

Gong Da's parents heard that their son was sentenced to death, and found Song Hui again, crying and wiping tears, asked Song Hui to try again, and Song Hui had no choice but to take the case.
