Chapter 375: Supplemental Officials are not bored
After listening to Wang Hao's explanation, Wang Xin finally decided to join the council, and the 'Eight Pi' eventually became the 'Three Pi'.
At this time, it was already a little inappropriate to call it 'Babi', so Wang Xin changed 'Babi' to 'three discussions'.
Although the 'Three Discussions' left a judicial backdoor for many people and gave them judicial privileges, under the centralized system of feudal monarchy, this kind of thing was unavoidable.
As the saying goes, half a step ahead is a genius, and one step ahead is a madman.
Wang knows very well that the progress of society and the development of the times must match, which is not only said in the books left by Zijue, but also in various books and history books that Wang has preserved over the years.
It's like the etiquette of the Bang Zhou period, and now there are many things that don't apply. Can the Ida system of the past continue to be used? Definitely not.
Therefore, although the Wang family respected Confucius, they did not agree with some of his doctrines. At the same time, he was very disgusted with the ancient practices of Confucianism.
Confucianism often reveres some of the holy kings of antiquity as a way to advise. However, the Wang family is a family that has been inherited from the Yin Shang dynasty, and knows the history of the ancient Yin Shang period better than them.
Therefore, whenever Confucianism wants to take the events of ancient times to advise, Wang can always take out a more detailed record, and the Confucian scholars who argue are speechless.
For the behavior of worshiping the past and degrading the present, Wang has always disliked it. Do they really worship the ancients? If you really want them to live in that era, it is estimated that few people can stand it, and they worship the past just to belittle the present.
Putting down things they don't like or support, or things that hurt their interests. Their purpose was never pure.
As for the ancient period, when the holy king was alive, the people lived in peace, everyone had land, the world was under great rule, and so on, the real situation was that the productivity of primitive society was low, and the so-called people lived and worked in peace and contentment, which was completely nonsense.
Times are changing, and the laws of Daqian also need to be constantly improved.
The Wang family did not engage in any ancestral law immutability, starting from Huaiguo, the Wang family has taken the initiative to promote reform.
After the "Great Dry Law" was revised and supplemented, some other problems arose. 'Fines to atone' and 'Officials to recognise crimes'.
The article of 'fine atonement' existed in the Xia Dynasty, and even if the law was changed several times, this article was not canceled, and one of the very important reasons was the problem of money.
"The Xia Hou clan will not kill or be punished, and the death penalty will be 2,000 meals." This sentence refers to the king of the Xia Dynasty who could atone for the death penalty with a fine.
A meal is a unit of weight, equivalent to six taels of copper, and two thousand dishes are equivalent to three hundred and seventy-five pounds of copper, which can be exempted from capital crimes.
What was copper at that time? It's weapons, it's wealth, it's extremely important for a country.
Since then, each has had a way of atonement for sins with fines. Daqian also had fines to atone for their crimes, but of course, in the Daqian Law, the crime of murder and death could not be atonemented with a fine, and later it was added that exile could not be done.
Legalists have always debated the atonement of fines, and there are two of the most controversial ones.
First, the atonement of fines may lead to different punishments for the rich and the poor, and the crimes of the rich and the crimes of the poor are completely two forms of punishment, and even some extreme ones are the life of the rich and the death of the poor.
Second, a fine of atonement may lead to reoffending. There is a very real problem here, in order to raise the cost of atonement, the offender may take the risk and commit another crime.
Or it can be said that the atonement of fines makes the law lose its deterrent effect on the rich, giving them the illusion that they can do whatever they want as long as they have money, which leads them to trample on the law and finally make the law a dead letter.
However, it would not be possible to completely ban such fines to atone for sins, and in such an era, it cannot always be a severe punishment, and appropriate mercy is necessary.
After some discussion with many great sages of the Legalist family, Wang Xin finally retained the 'fine atonement', but the scope of the fine atonement was further narrowed.
For minor offenses, punishment is with whipping, caning, or hard labor. Alternatives in disguise who have money to contribute power, or who are sentenced to several years in prison, can also pay a ransom, but as for exile and capital crimes, they cannot pay money to atone for their crimes.
In the past, the Daqian Law could pay money to atone for one's sin, but now it has been revised to one year of imprisonment before money can be used to atone for one's sins, and one year or more cannot be paid to atone for one's sins.
Compared with the money obtained by the fine and atonement, Wang Xin felt that the exile of his family had obtained more. Haoqiang everywhere is like a leek, cut a stubble, and it will not take more than ten years for a new Haoqiang to appear.
To curb the strong and powerful, we should promote sustainable fishing. In this way, not only can you gain a lot of wealth, but you can also continue to migrate to the frontiers.
After limiting the atonement of fines to a smaller scope, Wang Xin and the others began to discuss the article on the punishment of officials.
Another prominent contradiction between Legalism and Confucianism is that when officials discuss crimes, when the country was founded, they were quite lenient about this law, after all, the world has been in turmoil for many years, and there are too few people who can be officials, so they are more magnanimous.
But now that it has been decades since the founding of the country, the situation is completely different.
Confucianism respects the Zhou rites, and there is a saying that the punishment is not that of the doctor and the courtesy of the common man. Legalists, on the other hand, advocate that officials and civilians are guilty of the same crime. For a long time, there has been no clear statement in the "Great Dry Law".
At present, Wang Xin and the Legalist Daxian have summed up the situation of officials committing crimes and bending the law for personal gain since the founding of the country in conjunction with the Great Cadres.
Then it was found that the number of official crimes has been rising, and the harm caused by official crimes is far from comparable to that caused by crimes committed by ordinary people.
Wang Xin said directly: "Knowing the law and breaking the law, the crime will be added to the first." In the future, the punishment for crimes committed by officials will be added to the punishment for crimes committed by the people! ”
Wang Xin's attitude made many Legalist disciples extremely supportive, but others felt a deep malice towards this set of punishments.
If an official violates the law, the crime will be added to the crime!
Wang Xin handed over the supplemented "Great Cadre Law" to the left and right prime ministers, and then the left and right prime ministers and the three princes and nine secretaries checked it, and if there were any objections to it, they could write to Wang Xin, and the three princes and nine secretaries were silent when they saw the supplemented Great Cadre Law.
After a while, one of them said: "In the past, Shang Jun changed the law, and the Qin State was strong, but his law was not harsh, and even Shang Jun could not escape the law and kill himself in the end. ”
"You are waiting for today's law, not inferior to Shang Jun, you are not afraid of killing yourself?"
It's a pity that his remarks are completely playing the piano to the cow, and the Legalists have never been afraid of killing themselves by doing the law, what they are pursuing is to reform with the law. Even some of the more extreme Legalist disciples pursue Wuding food, and as for Wuding cooking, that is also a matter of the future.
Everyone looked at the supplemented law in front of them, this is too harsh, and the officials are not happy!
