China Law and Order and Internet Writing
How is security in China?
In the 80s and 90s, China's public order was relatively chaotic, there were so-called triads at that time, there were many criminal cases of all kinds, and some crime-solving dramas were often seen on TV. But later www.biquge.info after the government cracked down on the underworld, public order gradually improved.
At the beginning of the 21st century, the so-called underworld forces still existed, and in some high-end places, gray and yellow, and there were many illegal phenomena. And in the corners of the city, you may encounter road rage and all kinds of bad guys. However, after the crackdown on pornography and illegal publications, especially after severely cracking down on some high-end venues with "backstage and background", many forces have silenced and looked for traces.
After the 18th National Congress of the Communist Party of China, all kinds of dark forces, and even officials who provided protective umbrellas, were severely cracked down, and social security improved significantly, reaching the level of Switzerland, which can be said to be the safest country in the world.
There may still be bad people, there may still be some violent incidents, some dark incidents, but the probability of encountering them is very low.
If one day, you meet a bad person, encounter a robbery, or assault, or assault, you can only say that you have won the 5 million jackpot, which is extremely rare.
Especially in today's era, the so-called safety first, once there are casualties, or even death, it can be said to alarm the whole province and even the whole country. Many local leaders put social security first, after all, once there are vicious casualties, the reputation of this urban area will immediately rot, and the political future of many officials will be affected.
Efforts to develop GDP, efforts to develop political achievements, and all the advantages of efforts have been erased in the face of vicious casualties, and they must also be held seriously responsible.
In the early days of reform and opening up, China had advantages in market, resources, and population, but now many of its advantages have disappeared or even become disadvantages.
In many regions, only a good market environment can attract investment. The key to a good market environment lies in social security, which is too poor and there is no confidence in investment.
Today, China as a whole has a very good security environment.
Novels, on the other hand, originate from reality, are higher than reality, and are the deepening and embodiment of reality.
In the novel, there are a lot of pretending to be slapping in the face, but in reality, it is not reliable at all, and it is an ugly version of reality.
In the novel, there was a verbal quarrel with some classmates, so he was retaliated by some classmates and hired underworld forces to beat him. But now, it is impossible, the quarrel between classmates, there may be fights, and there may be friendships, but the teacher will adjust, and the worst result is that the relationship between the two classmates has deteriorated, they are extremely estranged, and they are not dating, and there will be no hiring and beating incidents at all.
In the novel, some of the second generation of officials, the second generation of rich, will use the power of their parents to retaliate against the protagonist, and in reality, it may also exist, but it will not be as blatant and unscrupulous as in the novel, the more high-ranking officials, the more prominent the status, the more cautious, no one will be unscrupulous.
Many corrupt officials, before the incident, were modest and cautious, and they were all masters of the blue sky, and they had a good reputation among the people; as for those corrupt officials who publicize themselves everywhere and show themselves to be bad people, they are simply impossible in reality.
In the novel, some public procuratorial and judicial organs will become the protective umbrella and evil tools of some forces, but in reality, they may also be open to some forces and will also give convenience to some privileged characters, but they are far less exaggerated than in the novel.
In China, there are strict rules on the holding of guns or arrests by public prosecutors, prosecutors, and judicial officials, and they are not as unscrupulous as in the novel.
Article 5 of Chapter 2 of the "Firearms Control Law" clearly stipulates that "the people's police of public security organs, state security organs, prisons, and re-education through labor organs, the judicial police of the people's courts, the judicial police of the people's procuratorates, the procurators responsible for the investigation of cases, and the anti-smuggling personnel of the customs may be equipped with guns for official use if it is truly necessary to use them when performing their duties in accordance with the law."
(1) It is strictly forbidden to carry or use firearms in non-police activities;
(2) The firearm must be carried at the same time as the "People's Republic of China Official Firearm License", and the type and number of the firearm must be consistent with the content registered on the firearm license;
(3) Firearms must not be carried in areas or places where the carrying of firearms is prohibited as determined by the public security organs of the people's governments at the districted city level or above. When it is truly necessary to carry firearms through the above-mentioned areas and places due to work, the firearms should be deposited with the local public security security administration department or police station and go through the storage procedures. The public security management departments or police substations of public security organs at all levels should promptly accept the storage of firearms, and must not pass the buck, so as to ensure the safety of the storage of firearms;
(4) Do not carry firearms and drink alcohol;
(5) Guns must not be brought into restaurants, shopping malls, dance halls, and other places of public entertainment except for work needs;
(6) Firearms must not be carried in non-standard equipment except when it is necessary for the performance of the mission;
(7) Shall not use the equipped firearms for hunting;
(8) Firearms must not be rented, lent, transferred, gifted, or exchanged;
(9) Firearms must not be handed over to non-people's police for carrying or safekeeping;
(10) They must not repair firearms or replace firearm parts without permission;
(11) Firearms must be lost, stolen, robbed, or other accidents must be immediately reported to the local public security organs and the unit to which they belong;
(12) Accept inspections and annual inspections by the competent departments for firearms;
(13) Relevant provisions of other laws and regulations.
In the United States, it is easy to buy guns, and buying guns is like buying groceries, with a failure rate of less than 1%, and there are many gun crimes.
However, in China, law enforcement officers are only allowed to carry guns during their work hours, when they are enforcing the law to arrest criminals, and in normal times, guns are mostly locked in safes.
Many times, law enforcement relies on batons!
In China, there are three main conditions for an arrest:
1. There is evidence to prove the facts of the crime. This is the evidentiary, factual and precondition for arrest. According to the relevant judicial interpretations, this condition contains the following meanings: First, there is evidence to prove that a crime has occurred. This requires that the facts that have occurred must be facts constituting a crime and cannot be other facts, and that the existence of the facts of the crime has been proved by a certain amount of evidence; second, there is evidence to prove that the facts of the crime were committed by the criminal suspect; and third, the evidence proving that the criminal suspect committed the criminal act has been verified and true. If a criminal suspect has committed several criminal acts, as long as there is evidence to prove one of them, the requirement of "having evidence to prove the facts of the crime" is satisfied.
2. The possibility of a sentence of imprisonment or higher is a sentencing condition, a criminal responsibility condition, or a legal condition for arrest. Arrest, as the most severe coercive measure, should be applied to criminals of a serious nature, so the law provides that arrest is only applicable to those who may be sentenced to a sentence of imprisonment or higher, and not to criminal suspects or defendants who may be sentenced to controlled release, short-term detention, or independently applied supplementary punishments.
3. The use of methods such as release on guarantee pending further investigation and residential surveillance is not sufficient to prevent them from becoming dangerous to society, but arrest is necessary. This is based on the personal dangerousness of the criminal suspect or defendant. That is to say, if only the above two conditions are met, an arrest cannot be made, and it depends on whether there is a need for arrest. This condition is generally examined mainly from the following two aspects: first, whether the nature of the case is serious and whether it is heinous; second, the criminal suspect or defendant's own circumstances and the extent of subjective malice. If the use of bail pending further investigation or residential surveillance against a criminal suspect or defendant is sufficient to prevent danger to society, he should not be arrested, but should be subject to lighter coercive measures.
The above three conditions must be met at the same time, and all of them are indispensable.
Many online novels, especially urban ones, look too fake and unrealistic.
There may be dark events in society, but they are far less terrible than those written in the novel, and there may be bad people, but the bad people are shrewd and cautious, and they will not be as unscrupulous as in the novel.
The social reality described in online novels may be in line with some realities in China in the 80s, 90s, and early 21st century, but it is completely inconsistent with modern social reality.
Fiction should originate from reality, can transcend reality, but cannot transcend reality, is too fake, unreal, and lacks a sense of substitution.
