Chapter 270: The First Experience of Administration (Part II)
No matter what era there are, there are harmful sheep in the government, and it depends on whether the ruling organs dare to expose their scars and cut off the cancer. Regarding the corruption of civil servants, Zhang Hanqing believes that blindly high-pressure policies are not applicable, and high salaries are a reasonable way to maintain integrity. Following the practice of later generations and Singapore, the salary of civil servants is maintained at the upper level of the average social income, but not too much, and the main advantage is reflected in the "pension fund". Law-abiding civil servants, regardless of their final rank, can receive a large amount of "pension money" after retirement, which is a comfort to the vast majority of ordinary government officials who have never had the opportunity to move to higher positions in their lifetime.
In fact, the income of government workers can be clearly told to the public, and there is no need to hide it. In fact, what the common people in later generations criticized for the government's official affairs was not that they received more wages, bigger houses, and better welfare, but that their incomes were not transparent, redundant and inactive. The cadre hierarchy system should only be distinguished by the monetary method of salary, but in later China, in addition to salary differences, cadres of different grades also have hierarchical distinctions in many aspects, such as welfare housing, medical services, and the dual-track pension system. Therefore, no matter how the government reforms the administrative personnel, it will attract a lot of scolding on the Internet.
Since there is no distinction between high and low jobs, why are civil servants' pensions, housing provident funds and enterprise personnel two lines? Would it be easier to settle accounts between the two systems? Don't suffer from widowhood and inequality, it's not a matter of more money and less money but unfairness, and the officials who don't believe in future generations can't see or understand, but they are either vested interests, or the tail is too big to fall, and then carry out reforms when the climate is about to become a climate, and there is a lot of resistance!
If you have the opportunity, design a good rule from the start.
Not as a cure. The face is ugly, the door is difficult to enter, and things are difficult to do, that is spoiled by the country. If you don't take the initiative or do anything to make things difficult and cold-faced, if you encounter such a civil servant, you can just go directly to the Discipline Inspection Commission or the "Supervision Bureau" under the leadership of the top government to complain. Once the facts are true, the first warning, the dismissal of public office on the spot again, and the peeling of your skin to see that you have one more eye than Lord Ma or what? As soon as the "Regulations on the Discipline of Government Functionaries" were promulgated, it was refreshing.
Zhang Hanqing has designed various systems to prevent public servants from abusing their power, so is it safe if I don't do anything? No! Inaction is also a dereliction of duty! This is a typical "official master" style, which is especially hated by Zhang Hanqing, and is even less popular than corruption. Corruption is easy to detect, and inaction is hard to stop. What to do? Easy to do! Don't want to do something? Then clear out of the civil service! Where a major accident is caused by omission, a new crime of "dereliction of duty" is added.
These are still self-examination and self-correction, is there an institution to restrain the government? Parliament. Although the parliament will be controlled by the party in the future, it should have great binding force on the government, otherwise the name of the legislature is just a decoration? The appointment and dismissal of the top officials of government organs must be voted on by secret ballot, and officials must report to the parliament every year. In the event of a major event, the Parliament has the right to request the responsible official to come to the Parliament for questioning. Those who fail to pass the debriefing or questioning shall not be promoted within two years; If they fail to pass twice, they shall be transferred or demoted. All of this is written into the "Xinmin County Council Organization Measures".
Afraid of trouble, afraid of staring? Aren't you afraid that you don't want to be an official, there are still fewer people in China who want to be an official? You don't see the annual growth of the national examination team and the high proportion of national recruitment. There has never been a shortage of people in China who want to be officials!
The restraint on one is extremely weighty, and that is the outgoing audit system. In Xinmin County, a new "Anti-Corruption Office" was set up, with the county magistrate concurrently serving as the director, and the subordinate units had an audit bureau. The top leaders of the townships, towns, and bureaus under the county must conduct financial audits whenever they leave office.
In addition, cadres at and above the deputy section level are required to declare their assets, and they must explain in detail the reasons for the increase in assets when they report on their work in the parliament every year. Significant property and income from unknown sources that are deliberately concealed are criminalized as embezzlement. In addition, immediate family members who have foreign nationality are not allowed to hold official positions and are not allowed to be promoted. Those who do not report to the organization in advance will be directly expelled from the party by party members and dismissed from office by officials on the spot! Even his family doesn't want to be patriotic, but you can imagine what happened to this official! Whether to consider setting up a "naked official crime" in the future, Zhang Hanqing is not without speculation.
In fact, the biggest constraint on administrative officials is similar to the system of separation of military and government and separation of military and police, which is commonly known as the separation of powers. It is only when the administrative officials are under the supervision of another group of organizations that they have no control at all that they can do that the executive power can be locked into a cage, which is the original intention of Zhang Hanqing to design a new judicial system.
The Department of Public Procuratorate and Justice has always been a major headache in China. Since the founding of the People's Republic of China, the public security bureau has gone through five stages of exploration: director of the public security bureau, director of the public security bureau and deputy secretary of the political and legal committee, director of the public security bureau and secretary of the political and legal committee and member of the Standing Committee, director of the public security bureau and deputy director of the government government, and director of the public security bureau and deputy member of the Standing Committee. The power of the public security is increasing, and this is also the need to build a country with a rule of law.
Zhang Hanqing still believes that the names of the police department and police station of the Republic of China are more in line with the original intention of its establishment, and it should be an enforcement unit, and it should not have any power beyond the power of law enforcement. Whether the law can be enforced depends on the judgment of the court, and the challenge of the act is explained by the Bureau of Justice. In this way, things are done, and the possible adverse effects of the violent attribute are also small.
As a cultivation of the spirit of judicial independence, Zhang Hanqing does not intend to set up a full-time secretary of the political and legal committee, but only a full-time deputy secretary of the party committee. Whether this is the case at the top of the future will be seen and said. In this way, the Public Procuratorate, Procuratorate, and Justice Department has not departed from the party's leadership, but has also been able to maintain its independence to the greatest extent.
In order to prevent administrative interference, Zhang Hanqing also conceived a system of judges: In the future, a nine-member judicial committee will be set up to manage the courts according to the central government, provinces, cities, and counties, and the committees will be elected and composed of judges at the same level, and the committee will appoint one person as the president to be responsible for administrative affairs. Judges may not be dismissed unless they are found to have violated the criminal law or have been found to be unable to perform the duties of a judge by the judicial committee at a higher level, and the system is for life.
With regard to the system of electing judges, Zhang Hanqing made a more meaningful practice with reference to the later system of the West, mainly the United States, and combined with Chinese traditions.
First of all, the selection of judges is composed of lawyers, law professors, and outstanding assistant judges with certain qualifications, and their professional qualifications and abilities are assessed by the judicial bureau and submitted to the county assembly for voting. Once passed, judges become lifelong and cannot be dismissed without impeachment by a higher or equivalent judicial committee and with the approval of the parliament at the same level, so as to ensure the independence of judges.
By the vote of all the judges, a nine-member judicial committee is elected internally to perform the functions of administering the courts. The most senior of these is generally the Chief Justice, who also holds the office of President. The President of the Court is only an administrative position, responsible for the administrative affairs of the unit, but he is not qualified to interfere in the specific business of other judges, since he cannot decide whether other judges will stay or go.
In order to prevent the violation of the law by knowing the law, the "Judges Restraint Regulations", which later became the "Judges Law", imposed strict restrictions on such black sheep: judges who commit irregularities for personal gain or martyrdom in the trial of cases resulting in unjust, false and wrongly decided cases are guilty of other crimes; All cases that have been tried and concluded will be retroactively retained for life. In a sentence, "let the adjudicator decide, and the adjudicator is responsible".
Judges are paid the same salary as deputy county magistrates at the same level, and there is an opportunity in the future to delink the rank of the judge from the administrative rank and establish his own rank. At the present stage, the impartiality of judges should be promulgated in the form of articles and various systems should be used to restrain them, so that judges should become one of the most respected professions in the whole society, and in the future, a three-division system of "lawyers, accountants, and physicians" should be formed throughout the country, so as to be on par with the later advanced Western countries.
The procurator system is still under consideration, and the problem of China's judiciary is not how many restraints or supervision institutions are set up, but whether the degree of implementation of "strict law enforcement and prosecution of violators" is sufficient.
Zhang Hanqing's many practices and the introduction of a series of rules and regulations are dizzying. Once in practice, these systems have proven to be in line with national conditions, meet needs, be organized smoothly and operate efficiently. In particular, the founding of the People's Party, its propaganda of "centralism" and its independent judicial system make people have to admire the genius design of the young marshal.
Fortunately, Zhang Hanqing announced that this reorganization of the army would only be limited to the First Division and the Guards Division, and that other affiliated armies would not be involved, which greatly relieved some people in military circles who were watching from the sidelines. As a support, on the day of the meeting of the first Central Committee of the People's Party, the military and political leaders of the Fengtian Governor's Military Office and the former 27th Division appeared one after another to praise them, and the three veterans of the Fengtian Department, Zhang Zuolin, Sun Liechen, and Zhang Zuoxiang, also gladly accepted the titles of honorary chairman and vice chairman of the People's Party presented by Zhang Hanqing.
In order to give his son a platform, Zhang Zuolin also promised that if the pilot law in the Xinmin and Guard Brigade was successful, there would be a chance that it would be implemented in Mukden. For a while, Fengtian newspapers and newspapers rushed to report on this grand event, and no matter what the purpose was, all Fengtian people were proud to be selected as members of the People's Party.
Because of the old marshal's statement, Liu Shangqing and Mo Dehui, who had a good relationship with Zhang Hanqing, decided to join the People's Party, which made Governor Wang Yongjiang, who was greatly favored by the young marshal, also put down his burden and applied to join the People's Party as governor with a clear banner, so that the atmosphere of Fengtian changed. People with lofty ideals, intellectuals, and aspiring young people who are confused have all seen the dawn, thinking about Zhang Hanqing's judgment and practice on China's future direction in the program, and striving to join this party.
